18 ODTÜ öğrencisi ve 1 araştırma görevlisinin “Kanuna Aykırı Toplantı ve Yürüyüşlere Silahsız Katılarak İhtara Rağmen Kendiliğinden Dağılmama” suçlamasıyla tutuksuz yargılandığı davanın ilk duruşması 12 Kasım’da görüldü.

Ankara 39. Asliye Ceza Mahkemesi salonunun 11 sandalyelik toplam kapasitesinin sadece sanıkların oturması için bile yeterli olmaması nedeniyle, duruşma Ankara 15. Ağır Ceza Mahkemesi duruşma salonuna alındı. Yeni salondaki 5 kişilik sanık mahalinin savunmalarını yapmak üzere hazır bulunan 19 öğrenciye yetmemesi nedeniyle, izleyicilere ait 14 sandalye de sanıklara ayrıldı. Sanıklarla izleyiciler oldukça sıkışık bir vaziyette sandalyelerine oturdular. Hâkimin müsaadesiyle salonda yer bulamayan izleyiciler duruşmayı ayakta izledi.  Öğrenciler, 5 saat 40 dakika süren duruşmayı zaman zaman salonun zeminine oturarak seyrettiler.

Mahkeme koridorunda 30 kadar tam teçhizatlı çevik kuvvet polisinin beklediği görüldü.

Katılımcılar

Yaklaşık 50 kişilik izleyici kitlesi; Antalya BİZ Derneği, Ankara Barosu LGBTİQ+ Hakları Merkezi’nden üç avukat, çeşitli kurumlardan gazeteciler, Gökkuşağı Aileleri Grubu’nun da aralarında bulunduğu sivil toplum kuruluşları temsilcileri, öğrenciler ve diplomatik misyon gözlemcilerinden oluşuyor. Danimarka, İngiltere, İsveç, İspanya ve Avrupa Birliği duruşmaya gözlemci göndermiş.

Avukatların Ön Talepleri

Avukatlar, esasa dair savunmaya geçilmeden önce aşağıdaki saiklerle iddianamenin iadesini; bu mümkün olmuyorsa derhal beraatlerini talep etti:

  • İddianamedeki delillerle sanıkların tek tek ilişkilendirilmemiş olması
  • Bir temel hak ve hürriyet olan barışçıl şekilde toplanma hakkının kullanılmış olmasının kendisinin yargılamaya konu olmuş olması
  • Yargılamaya mesnet teşkil eden noktalardan biri olan, Onur Yürüyüşü’nün yasaklanmış olduğu iddiasına dair dosyada herhangi bilgi veya belge bulunmaması

Hakim, davanın halihazırda açılmış olması nedeniyle iade ve beraat taleplerini reddetti. Sanık öğrencilerin savunmalarına geçildi.

Sanık Öğrencilerin Savunmaları

Mikrofondaki teknik aksaklığın giderilmesinin ardından, öğrenciler savunmalarına başladılar.

On dokuz sanığın savunmasının tamamında öne çıkan tema, polisin uyguladığı keyfi orantısız güç iddiaları oldu.

Kürsüye gelen öğrenciler, ODTÜ’deki Onur Yürüyüşü geleneğinin tarihsel arka planını ve valiliğin Kasım 2017’de yasaklama kararından itibaren gelişen hukuki süreci anlattılar. Yargılamaya konu olan etkinliğin bugüne kadar düzenlenen dokuzuncu yürüyüş olduğunu, Ankara Valiliği’nin yasaklama kararının haklı bir karar olmadığını, ikinci yasak kararınınsa zaten bir yasak olmadığını; bir iç yazışmadan ibaret olduğunu söylediler.  Yürüyüşün yasaklanmamış olduğuna dair hukuki nedenleri anlattıktan sonra 10 Mayıs günü yaşananları, onur yürüyüşünü niçin organize ettiklerini ve yürüyüşün ne ifade ettiğini anlattılar.

Sanık ODTÜ’lülerin hepsi duruşmada savunma yaptı. Savunmalarında polis müdahalesinin gerçekleştiği 10 Mayıs’ta neler yaşandığını anlattılar. Bazıları orada tesadüfen bulundukları için, bazıları da anayasal bir hak olan toplanma özgürlüğünü kullandıkları için gözaltına alındıklarını ifade ettiler.

Öğrencilerin polislerin Onur Yürüyüşü’ne müdahalesi hakkındaki eziyet ve kötü muamele iddiaları kayıtlara geçti.

Öğrencilerin savunmaları sırasında avukatlar da açıklık getirmek istedikleri noktalara dair onlara sorular sordular.

Avukatların Savunmaları

Avukatlar; Onur Yürüyüşü’nün yasak olup olmadığı hakkındaki yargı kararının Ankara 7. İdare Mahkemesine sorulmasını ve olay anlarına ait ham görüntül kayıtlarının kolluk tarafından mahkeme heyetine sunulmasını talep ettiler. Talepler kabul edildi.

Savunma makamı adına ilk söz alan İzmir Barosu LGBTİ+ Hakları Komisyonu üyesi Mahmut Şeren, polisin hem Onur Yürüyüşü gününde hem de duruşma günü aynı “3dk içinde dağılın” uyarısını yaparak aynı gerekçelerle barışçıl toplanma özgürlüğüne müdahale ettiğine dikkat çekti. Saatlerdir süren savunmalarda polisler hakkında farklı işkence iddialarının kayıtlara geçtiğini belirterek Şeren cezasızlık vurgusu yaptı:

 “İnsanların eşcinsel ve trans oldukları için şiddet gördükleri bir ülkede LGBTİ+'ların hak savunuculuğu çok kıymetlidir ve devlet tarafından korunmalıdır.”

Anayasa Mahkemesi ve Yargıtay’ın barışçıl toplanma hakkını garanti altına aldığını belirttikten sonra ekledi:

“Eğer yetkililer illa ki bu yürüyüşü istemiyorlarsa, yapabilecekleri tek şey o yürüyüşe katılmamaktır.”

Şeren’den sonra söz alan Ankara Barosu LGBTİQ+ Hakları Merkezi Başkanı Av. Doç. Dr. Öykü Didem Aydın, öncelikle bir yasaklama kararının varlığının tespiti için valiliğe yazı yazılmasını mahkemeden talep etti.

ODTÜ rektörünün Ankara Barosu’nun görevlendirdiği bir avukat olarak kendisinin kampüse alınmaması talimatı verdiğini ve bu nedenle Prof. Dr. Verşan Kök hakkında suç duyurusunda bulunduğunu belirtti. Kolluk kuvvetlerinin sert müdahalesi için “sürek avı” benzetmesini yaptı.

Aydın’ın geniş bir çerçeveden hukuki ve kavramsal bir tartışma yürüterek gerçekleştirdiği savunmasının sonunda beraat talep etmesinin ardından, diğer avukatlar da beraat ile birlikte kolluk kuvvetleri hakkında suç duyurusunda bulunulmasını talep ettiler.

Karar

Mahkeme, (1) yargılamaya mesnet teşkil eden yasaklama kararının durumunun öğrenilmesi için idare mahkemesine 2019/893 esas sayılı dosyanın sorulmasına, (2) Ankara Emniyet Müdürlüğü’nün ilgili birimlerinden “ODTÜ'de 10/05/2019 tarihinde gerçekleşen fiillere ilişkin görüntülerin tamamının” istenmesine, (3) bu görüntüler edinildikten sonra “tarafsız bilirkişi heyeti tarafından inceleme yaptırılması talebinin değerlendirilmesine” karar verdi.

Davanın 2. Duruşması 12 Mart 2020, saat 09:00’da görülecek

The first hearing of the court case in which eighteen  METU (Middle East Technical University) students and a research assistant, who are charged with “unarmed participation in unlawful assembly or demonstrations and resisting despite warning,”  was held in Ankara 39th Criminal Court of First Instance on November 12, 2019.

Because the capacity (11 seats) of Ankara 39th Criminal Court of First Instance was not sufficient even for the number of the students on trial, the hearing was moved to the courtroom belonging to Ankara 15th Heavy Penal Court. Considering the five seats arranged for the tried, the new courtroom was not enough for 19 individuals either. 14 seats reserved for the observers were given to the tried.

Observers and suspects ended up sitting next to each other in a remarkably dense manner. The judge allowed the observers to watch the hearing on foot. From time to time, the observing students were seen to be watching the trial sitting on the surface of the courtroom.

Around thirty riot police officers were seen to be positioned in the court corridor.

Observers
Among some fifty individuals occupying the seats, representatives from a range of NGOs and diplomatic missions and students were present. Lawyers from Antalya BİZ Association, Ankara Bar Association LGBTIQ+ Rights Center; journalists and families from Rainbow Families group and delegates from UK, Denmark, Sweden, Spain and EU observed the hearing.

The hearing began at 09:00.

Initial Requests by Lawyers
Before they addressed the merits of the case, lawyers of students requested the indictment to be returned to the prosecution. If not accepted, they requested students’ immediate acquittal on the grounds below:

  • Pieces of evidence in the indictment were not individually associated with the tried students.
  • The fact that having exercised the right to peaceful assembly is the mere object matter of the criminal case.
  • There is no evidence in the case file regarding the argument that LGBTI+ Pride is banned, which is one of the main grounds of the prosecution.

The judge refused the requests on the basis that the court case had already been started.

Defenses of the Students on Trial
After a technical problem in the microphone was restored, students began their defense.

The common utterance in the statements of all 19 defendants was police’s arbitrary use of disproportionate force.

For 3 hours and 35 minutes, students on trial explicated the historical background of the tradition of METU Pride and the judicial process since Ankara Governorate’s blanket ban on all LGBTI+ events entered into force in November 2017. They stated that the event on trial was the ninth Pride until then and that the Ankara Governorate’s decision had not even been lawful. They also articulated that the second ban itself was not a ban, but rather an internal correspondence. After they explained the legal reasons on why Pride could not be considered as having been banned, they clarified why Pride was organized and what it means.

In the hearing of the criminal court case, where all 19 defendants presented their defense, what happened on May 10th were addressed by each defendant’s perspective. According to the accounts of the defendants who ended up under custody, some were just unfortunate to be at the wrong place at the wrong time; and some were “exercising their constitutional right to assembly.”

In the seven hours course of the hearing, students’ personal testimonies of torture and ill-treatment by the police were filed.

The defense lawyers asked them questions addressing the accusations and the police violence in order to clarify the points they were intending to make.

Lawyers’ Defense
Lawyers requested the court to ask Ankara 7th Administrative Court whether METU Pride had been banned and demand the visuals including raw footages of the incident to be presented to the court. The court accepted the requests.

Addressing the court first, lawyer Mahmut Şeren from İzmir Bar Association LGBTI+ Rights Commission noted that the police had interfered in the freedom of assembly as it did that day in front of the courthouse. Pointing out to the fact that the accounts of students including a range of different allegations of torture have been filed, Şeren put emphasis on impunity.

“In a country where people are exposed to violence because they are trans or homosexual, LGBTI+ community’s defense of human rights is enormously valuable and should be protected by the state,” Şeren said.

Reminding that the Constitutional Court and the Court of Cassation guarantees the right to peaceful assembly, Lawyer Şeren drew the line for the decision-makers:

“If officials strongly dislike this parade, the only thing they could do is not to attend it.”

The next defense lawyer Associate Professor Öykü Didem Aydın from Ankara Bar Association LGBTIQ+ Rights Center requested the court to firstly write an official letter to Ankara Governorate asking whether a proscriptive decision was existent.

Aydın uttered that they filed a criminal complaint about the METU Rector Prof. Dr. Verşan Kök because the rector had instructed not to let Aydın, as a lawyer tasked by Ankara Bar Association, in the campus. Aydın referred to “persistence hunting” as a metaphor for the heavy-handed police intervention.

Ensuing Lawyer Aydın’s request of acquittal at the end of their defense, other defense lawyers requested the court to file a criminal complaint about the law enforcement officers involved.

Decision
At the end of the first hearing, Ankara 39th Criminal Court of First Instance ruled to:

  1. Inquiring the case file 2019/893 from the administrative court in order to clarify the status of the proscriptive decision.
  2. Requesting “all the footages showing the acts that took place in METU on 10/05/2019” from the Security Directorate of Ankara.
  3. Reevaluating the request of the defense for the examination of the footages by a neutral panel of experts upon obtainment.

The next hearing of the case will be held on 12/03/2020 at 09:00.
